ART ACT 2021, What does a common man needs to know?

With the ART ACT 2021, gone are the days when we all must have read in the newspaper that 70-year-old couples become parents. So what's wrong with this it’s good news for them then why the government has come up with ART ACT 2021, ‘What does this act mean for common public?’

To protect the rights of common people pregnancy at a very advanced age has a detrimental effect and even leads to mortality. ART ACT 2021 was brought into force in June 2022 and encompasses all the ART centers across India and regulates them.

Who can avail of ART services?

Only the people falling under this age group are eligible to have ART services.
• Female with age 21-50 years
• Male with age 21-55 years

Who can provide the ART services?

Only the registered ART Clinics, Surrogacy clinics, and ART Banks can provide ART services because these entities will be under regular surveillance from the National and State ART Board.

Will known oocyte and sperm donors be allowed?

• Yes, as per the new ART Act there is no need for the donor oocyte to be anonymous and a known donor can donate eggs but she should be registered through registers ART Bank.

• Same with the sperm donor relative is allowed but through a registered bank and quarantine of sample for 6 months to rule out the viral disease window period.
